Professional vs Retail Trader in the EU

Should you upgrade to professional status? Understand what you gain, what you lose, and how to decide.

Criteria for Professional Classification

Under MiFID II, brokers can reclassify retail clients as “elective professional clients” if the client meets at least two of the following three criteria:

1. Sufficient Trading Activity

You have carried out transactions of significant size in the relevant market at an average frequency of at least 10 per quarter over the previous four quarters (i.e., 40+ trades in the past year).

2. Large Financial Portfolio

Your financial instrument portfolio, including cash deposits and financial instruments, exceeds EUR 500,000 in total value.

3. Relevant Professional Experience

You have worked in the financial sector for at least one year in a professional position that requires knowledge of the transactions or services envisaged (e.g., as a trader, portfolio manager, or financial analyst).

  • Higher leverage (typically up to 200:1 - 500:1)
  • No standardized risk warnings
  • Access to additional products or promotions
  • No margin close-out rule at 50%

What You Lose

  • Negative balance protection (you can owe the broker money)
  • Investor Compensation Scheme coverage (ICF)
  • Best execution obligation
  • Suitability and appropriateness assessments

How to Apply for Professional Status

  1. Request reclassificationthrough your broker's client portal or by contacting their support team. Most brokers have a dedicated form for this.
  2. Provide documentation proving you meet at least two of the three criteria. This may include trading statements, bank statements, and employment references.
  3. Acknowledge the risks by signing a document confirming you understand the protections you are giving up.
  4. Wait for approval. The broker will review your application and may request additional information. Processing typically takes 1-5 business days.

You can request to be reclassified back to retail status at any time, and the broker must comply.

Should You Upgrade?

Professional status is not a badge of honor. The loss of negative balance protection alone means that in extreme market conditions (such as the 2015 Swiss franc event), you could end up owing money to your broker beyond your deposit.

Consider upgrading only if you are an experienced, consistently profitable trader who genuinely needs higher leverage for their strategy and can absorb potential losses beyond your deposit. For the vast majority of retail traders, the ESMA protections are valuable safety nets that outweigh the benefits of higher leverage.

Our recommendation: Unless you have a clear, specific reason for needing higher leverage and fully understand the risks, keep your retail classification. The protections are there for a reason, and even experienced traders benefit from them.
